The Dominican Republic is the country with
the most advanced legislation in divorce
matters, which allows foreigners to obtain
a divorce, if both spouses agree, by means
of a proceeding accomplished in 72 hours.
To perform a quick divorce
between foreigners, one of the spouses must
appear before a Dominican Civil Court and
the other one must grant a Power of Attorney
to a Dominican lawyer.
If spouses have an agreement
on the division of property acquired during
marriage, the agreement may be submitted
to the Dominican Civil Court for its approval.
A divorce fulfilled anywhere
in the world is valid in the country of
origin of the divorced parties, as well
as in every other country, since it is a
rule of International Law that the
status and capacity of persons follow them
any place they are. Hence a modification
or change of the civil status of two persons
may be accomplished wherever they are.
The total cost of the proceeding
is US$1,750.00. This includes professional
fees, judicial charges, one copie in Spanish
of the divorce decree, duly certified at
the Secretariat of the Court that passed
the judgement, authenticated
at the General Attorney's Office, the Secretariat
of Foreign Affairs and the Consulate of
the parties origin country, besides, one translation of the judgement rendered by a Judicial Interpreter.
